    THE WEBSITE RESPONSIBILITY BILL

    WHEREAS under current law, responsibility for 'overseeing the Internet presence of the Kingdom' is currently the responsibility of the Scribery:

    and WHEREAS this has led to a neglect of the outwards-facing Internet presence of the Kingdom;

    and WHEREAS the responsibility of the Scribery for Talossa's internet presence in C.1.2 conflicts with the responsibility given to the elected Government in A.20;

    and WHEREAS this function should properly be the responsibility of the elected Government, and the Scribery should concentrate on its core function of keeping public records:


    BE IT ENACTED by the Ziu as follows:

    1) The following additional paragraph shall be added to El Lexhátx D.2.10:


    2.10.3 As part of their duties as described in D.2.10 above, the Ministry of Stuff shall be responsible for the content of the publicly-readable Internet presence of the Kingdom, excluding those websites under the jurisdiction of other entities of the Kingdom as described in El Lexhátx A.20 or elsewhere in El Lexhátx. They shall be directly responsible for the content of one or more websites named as the 'official' website(s) of the Kingdom, and ensuring the availability for all Talossans of the following:

    a) the records of the Scribery as described in C.1.2;
    b) up-to-date information on the personnel of all Government, Royal Household, Civil Service and Chancery office-holders.


    2) El Lexhátx C.1.2 shall be amended by the deletion of the phrase in "strikethrough" = below:

    The Scribery of Abbavilla, headed by the Scribe of Abbavilla. The functions of the Scribery are to maintain and publish the Organic and statutory laws of the Kingdom, and oversee the Internet presence of the Kingdom.

    WHEREAS the author of that original bill was clearly stupid and unable to write clearly AND

    WHEREAS I just looked who was the author so please ignore the previous WHEREAS 

    THEREFORE the Ziu resolves to amend El Lexhatz, Article C, Section 1.1.1 which currently reads:

    1.1.1. Members of the Chancery are to be considered as if they were Deputy Secretary of State, without the ability to replace the Secretary should he become available. Members may act in the name of the Secretary of State and perform official business as delegated to them by the Secretary. (30RZ11)

    Rejected by the Senäts

    WHEREAS elections now occur the month after the dissolution AND

    WHEREAS the dissolution was on January 4th AND

    WHEREAS this section of the organic law means the election starts on Februrary 15th AND

    WHEREAS there is no provision for that additional month of waiting, therefore causing an impossible contradiction in the organic law 

    THEREFORE the Ziu resolves to put to referendum the follow amendment to the organic law, in Article VII

    Section 3, which currently reads:

    All elections to the Cosa are to be conducted during a period beginning from the fifteenth day of the calendar month following the dissolution of the prior Cosa until 7:30 p.m. on the first day of the subsequent month. The first day of this period (the fifteenth) is called the "Balloting Day" and the final day is called the "Election Deadline."

    is replaced by:

    All elections to the Cosa are to be conducted during a period beginning from the fifteenth day of the calendar month following the last Clark or final month of Recess of the prior Cosa until 7:30 p.m. on the first day of the subsequent month. The first day of this period (the fifteenth) is called the "Balloting Day" and the final day is called the "Election Deadline."

    • C. Fundraiser Authorization

    FURTHERMORE the Seneschal of the Kingdom of Talossa, or his appointed deputy, shall undertake to create, manage, and promote a voluntary fundraising campaign to the citizens of Talossa and other interested parties over the course of this term.  The targeted amount for this campaign shall be ℓ40 ($60 USD), in accordance with the direction of Lex.D.2.1.5.4.  The fundraising campaign will end once this target is reached, and no more than one fundraising campaign is authorized.  The proceeds from seigniorage, sales of stamps, contributions from official Supporters of Talossa, and other moneymaking schemes shall be counted towards this fundraising target if the Seneschal, or his appointed deputy, so choose.

    FURTHERMORE the Minister of Finance of the Kingdom of Talossa, or his appointed deputy, undertake to create, manage, and promote a voluntary fundraising campaign to produce supplementary funds for the production of coins to the citizens of Talossa and other interested parties over the course of this term.  On this basis shall the number of coins minted be determined, as decided by the Government based on the interest expressed and funds raised.

     D. Investment Policy

    FURTHERMORE His Majesty’s Government hereby directs the Burgermeister of Inland Revenue to continue to invest all held funds into an interest-bearing savings account, but to keep an additional separate tally of all income to date that has been derived from the sale of stamps.

    WHEREAS the Boss from Bosporus, Turkish President Recep Tayyip Erdoğan, is one of the most annoying, despicable, and ridiculous political figures of our time, and
    WHEREAS the Boss from Bosporus has done many an illegal thing, one of which was to build a Presidential Palace with 1000 rooms with a converted value of roughly 203 million Louise (~305 million USD) in a nature reserve, and
    WHEREAS the Boss from Bosporus has defied orders from Turkey's courts, including the highest court, forbidding him to continue building his Presidential Palace, and
    WHEREAS recently, the Boss from Bosporus has, with disesteem to diplomatic decorum, summoned the German ambassador to Turkey to appear before the Turkish Ministry of Foreign Affairs due to a satirical video published in Germany criticising his person, and
    WHEREAS apparently criticism of his person seems to make the Madman from Bosporus even madder, and
    WHEREAS democracy is something he wants to do away with, and
    WHEREAS we never want political satire to be something journalists could get incarcerated for in Talossa, now

    THEREFORE resolve the Ziu to add following new section 35 to Title F. Culture of the Organic Law, after section 34:
     

    35. Every Talossan is encouraged to exercise freedom of speech, and to voice his or her critical opinion of public, or political figures, and their actions, within the limits of law. The Ziu especially encourages the citizens of our Kingdom to generate many so-called memes to draw attention to unjust, undemocratic, or illiberal heads of state with tendencies towards megalomania, despotism, fascism, or radical nationalism, be they within or without Talossa.

    The subsequent sections in Title F shall be renumbered accordingly to fit this new section in.

    FURTHERMORE the Ziu condemns the erratic actions of Turkish President Recep Tayyip Erdoğan, and reminds him, and the People of the Republic of Turkey, of the importance of democracy, freedom of speech, and rule of law.

    WHEREAS the Cunstaval is the organically mandated representative of the Crown in a province; and

    WHEREAS the Cunstaval may, in certain situations, exercise all the powers of the provincial government; and

    WHEREAS the Cunstaval should have the full trust and confidence of the people from the province where he or she will have power over; and,

    WHEREAS it is only possible to earn a province's full trust and confidence if the Cunstaval belongs to the province that they will have power over; and

    WHEREAS most Cunstavals are not residents of the provinces they have power over, and non-residents are still being appointed by the Crown to represent a particular province; and

    WHEREAS the practice of appointing a non-resident as Cunstaval is not fully reflective of the will of the residents of a province where the former will have power over; and

    WHEREAS the above-mentioned practice may only cause distrust and resentment between the Crown and its subjects; now

    THEREFORE Org.17.9, which currently reads

    Each Province shall govern itself in such a manner as to guarantee its citizens the full protection of their rights under this Organic Law. Provincial elections may, if so specified in a Province's constitution, be conducted by the Chancery at the same time as elections to the Cosâ, and in accordance with the national election laws and rules. The King shall appoint a Cunstavál (or Constable) for each Province. Until such time as the King or Cunstavál proclaims a provincial constitution providing otherwise, a Province's Cunstavál shall serve as Military Governor and may exercise all the powers of the provincial government. No Cunstavál shall proclaim any provincial constitution or constitutional amendment which:

    - Conflicts with any provision of this Organic Law,
    - Grants to the King (and consequently to the Cunstavál as the King's representative in the Province) royal powers less extensive than those granted to the King on the national level, except that the provincial royal powers need not include a right of dissolution if provincial elections are held concurrently with Cosâ elections,
    - Fails to provide a right to appeal decisions of the provincial court or courts (if any) to the Cort pü Înalt or such other national courts as may be created by the Ziu, or
    (In the case of the adoption of a new constitution, is not approved by a referendum in which at least either a majority of all citizens of the province or a two-thirds majority of votes actually cast is in favor of the constitution.)


    shall be amended to read,

    Each Province shall govern itself in such a manner as to guarantee its citizens the full protection of their rights under this Organic Law.     - Grants to the King (and consequently to the Cunstavál as the King's representative in the Province) royal powers less extensive than those granted to the King on the national level, except that the provincial royal powers need not include a right of dissolution if provincial elections are held concurrently with Cosâ elections,
    - Fails to provide a right to appeal decisions of the provincial court or courts (if any) to the Cort pü Înalt or such other national courts as may be created by the Ziu, or
    (In the case of the adoption of a new constitution, is not approved by a referendum in which at least either a majority of all citizens of the province or a two-thirds majority of votes actually cast is in favor of the constitution.)

    BHAID Disbursement (II) Act

    Whereas, the Bureau for Humanitarian Aid and International Development was transferred the outstanding contributions in the amount of $192.56 from its now-defunct predecessor, Talossa AID, and

    Whereas, BHAID also conducted a turnout prediction contest during the 49th Cosa General Election raising a total of $20, and

    Whereas, pursuant to 48RZ17, the Humans Helping Other Humans Act, the Board of Governors convened and resolved to donate these funds to GiveDirectly.org and the International Foundation for Electoral Systems, respectively, as a part of BHAID’s international development mandate.

    Therefore be it resolved that the Ziu authorizes the Bureau of Humanitarian Aid and International Development to contribute $192.56 (128.37 Louise) to GiveDirectly.org and $20 (13.33 Louise) to the International Foundation for Electoral Systems.

    Statute

    WHEREAS, at present, the catchment areas of provinces in Talossa are patchy and uncongrous; and

    WHEREAS what this means is that provinces have become more and more Senatorial voting clubs rather than meaningful groups of people with common geographical or cultural origins; and

    WHEREAS while a balanced intake of immigrants, geographical contiguity and common cultural roots may very well be impossible to achieve all at the same time, this is still a step in the right direction to achieve just that; so

    THEREFORE the Ziu hereby amends El Lexhatx section E article 7 as detailed below.

    Article 7.3.3 is added with the following text:

    7.3.3 Any citizen who happens to find himself living in the catchment area of a different province, subsequent to the creation of a new province or the alteration of catchment area boundaries, will be allowed to choose between remaining a citizen of his current province or becoming a citizen of the province whose catchment area he now lives in. The provisions of article 7.3.2 apply to this rule as if the citizen is assigned to the wrong province.

    Articles 7.4 to 7.11 are amended as follows:

    7.4. ATATÜRK PROVINCE. Talossan citizens living in the following areas shall be assigned to Atatürk Province: All suburbs of Milwaukee within Milwaukee County, which lie to the north and east of the City of Milwaukee; the Wisconsin Counties of Washington, Ozaukee, Sheboygan, Calumet, Manitowoc, Kewaunee, and Door; and the U.S. states of Massachussetts, Rhode Island, Maine, New Hampshire, and Vermont, and the Canadian provinces of Quebec, New Brunswick, Prince Edward Island, Newfoundland & Labrador and Nova Scotia.
     Overseas, the nations of Russia, Azerbaijan, Armenia, Uzbekistan, Georgia, Tajikistan, Belarus, Kyrgyzstan, Turkmenistan, Kazakhstan, Turkey, Northern Cyprus, Syria, Lebanon, Israel, Palestine, Jordan, Iraq, Iran, Afghanistan, Pakistan, India, Bhutan, Sri Lanka, Banghladesh, Maldives, Nepal, Saudi Arabia, Kuwait, Bahrain, Qatar, UAE, Oman, Yemen, Egypt, Sudan, South Sudan, Djibouti, Eritrea, Ethiopia, Somalia, Kenya, Tanzania, Uganda, Rwanda, Burundi, Dem. Rep. of the Congo, Rep. of the Congo, Gabon, Sao Tomé, Cameroon and Equatorial Guinea.

    7.5. BENITO PROVINCE. Talossan citizens living in the following areas shall be assigned to Mussolini Province: the Wisconsin counties of Waukesha, Jefferson, Dane, Marathon, Wood, Portage, Waupaca, Waushara, Winnebago, Marquette, Green Lake, Fond du Lac, Columbia, and Dodge. Overseas, the nations of Italy, San Marino, Vatican City, Switzerland, Liechtenstein, Austria, Spain, Portugal, Andorra, Slovenia, Croatia, Bosnia-Herzegovina, Hungary, Serbia, Montenegro, Kosovo, Macedonia, Albania, Greece, Romania, Bulgaria, Moldova and Cyprus; plus all nations in Africa north of the Equator not listed elsewhere.

    7.6. VUODE PROVINCE. Talossan citizens living in the following areas shall be assigned to Vuode Province: The City of Milwaukee (WI) and the U.S. states of Connecticut, New Jersey, New York, Pennsylvania, Ohio, Indiana, Illinois, Michigan, Iowa, Missouri.

    7.7. MARICOPA PROVINCE. Talossan citizens living in the following areas shall be assigned to Maricopa Province: the Wisconsin counties of Polk, Barron, St. Croix, Pierce, Dunn, Chippewa, Eau Claire, Clark, Pepin, Buffalo, Trempeleau, Jackson, La Crosse, Monroe, Juneau, Adams, Vernon, Crawford, Richland, Sauk, Grant, Iowa, Lafayette, and Green; and the U.S. states of Arizona, New Mexico, Oklahoma, Texas, Hawaii, California, Arkansas and Louisiana. Overseas, the nations of South America (except Brazil) and all of continental Central America.

    7.8. FLORENCIA PROVINCE. Talossan citizens living in the following areas shall be assigned to Florencia Province: the Wisconsin counties of Florence, Douglas, Bayfield, Ashland, Iron, Vilas, Burnett, Washburn, Sawyer, Rusk, Taylor, Price, Oneida, Lincoln, Langlade, Forest, Menominee, Shawano, Marinette, Oconto, Outagamie, and Brown; and the U.S. states of Alaska, Washington, Oregon, Idaho, Wyoming, Nevada, Utah, Colorado, Minnesota, Montana, North Dakota, South Dakota, Nebraska, Kansas, and the Canadian provinces and territories of Yukon, Northwest, Nunavut, British Columbia, Alberta, Saskatchewan, Manitoba, Ontario.

    7.9. MARITIIMI-MAXHESTIC PROVINCE. Talossan citizens living in the following areas shall be assigned to Maritiimi-Maxhestic Province: All suburbs of the City of Milwaukee within Milwaukee County which lie to the south and west of the City of Milwaukee, and also the Wisconsin Counties of Racine, Kenosha, Walworth, and Rock; and the U.S. states of Alabama, Florida, Georgia, Kentucky, Mississippi, North Carolina, South Carolina, Tennessee, Virginia, West Virginia, the District of Columbia, Delaware and Maryland. Overseas, all the nations of insular Central America and Puerto Rico.

    7.10. CÉZEMBRE PROVINCE. Talossan citizens living in the following areas shall be assigned to Cézembre Province: the nations of Ireland, United Kingdom, Iceland, Sweden, Finland, Denmark, Norway, Estonia, Latvia, Lithuania, Poland, Ukraine, Czech Republic, Slovakia, Germany, Netherlands, Belgium, Luxembourg, France, Monaco and any European nation not listed elsewhere.

    7.11. FIOVA PROVINCE. Talossan citizens living in the following areas shall be assigned to Fiova Province: the nations of Australia, New Zealand, all Oceanian nations, all Asian nations not listed elsewhere, Brazil, South Africa, Madagascar, Lesotho, Swaziland, Mozambique, Zambia, Zimbabwe, Botswana, Namibia, Malawi, Angola, and all nations in Africa north of the Equator not listed elsewhere, and all nations of the world not included elsewhere.

It is a contractual agreement between parties, signed onto by their own consent, and is a guaranteed right regardless of sex or sexual orientation. Any sacredness of marriage is between the parties involved and is a strictly personal issue. The Kingdom of Talossa recognizes any and all marriages that fall under this definition, hereby re-asserting the rights given to us by the Organic Law of Talossa. In addition, we would also like to provide Talossan Invincible Moral Support to those citizens of our Giant Friendly Neighbour who themselves are seeking to have the laws of that country reflect the far more progressive laws of the Kingdom of Talossa.

    Rejected by the Senäts

    WHEREAS El Lexhatx has provisions which only make suggestions, and

    Whereas, while there has been notable progress on gender equality generally over the past several decades there is still a long way to go in ensuring that girls receive equal consideration for their needs and dreams and toward the elimination of iniquitous discrimination and diminution of women’s equal right to civic personhood, and

    Whereas, this continued need for policy focus is represented by gender gaps in government service (women make up just 19% of the world’s parliamentarians), labor (women are represented at rates of only two-thirds those of her male counterparts in the global workforce), salary (women make an average salary less than half of their male counterparts), and

    Whereas, the Office of UN Secretary-General is one of the world’s most visible diplomatic and administrative roles and has been used in the past to highlight contemporary issues of global import. The campaign for who will replace the current Secretary-General, Ban Ki-Moon, is underway with unprecedented public interviews and presentation of credentials, and

    Whereas, there are female UNSG candidates of exemplary qualifications both within and outside of the UN system such as UNESCO Director-General Irina Bokova, UNDP Administrator Helen Clark, Natalia Gherman and Vesna Pusic. The symbolic importance for gender equality, for inclusion of diverse perspectives and for urgently necessary reforms in the election of a woman as UN Secretary-General is self-evident.

    Therefore, be it resolved that it is the Sense of the Ziu to encourage the United Nations Security Council and the United Nations General Assembly to review the qualifications of the current candidates for UN Secretary-General with careful consideration for the fact that the world organization has yet to be led by a woman and the fact that there is still much progress to be made with respect to gender equality.

    Whereas the Writ of Dissolution in the 48th legislature was issued too late by the king.

    Therefore we move the following amendment to the Organic Law : 

    Remove the word ''During '' in article XIII section 1 and replace it by the words ''Before the end of''

    Therefore Article XIII section 1 shall now be read:

    Section 1. Duration of the Cosâ. The Cosâ convenes two weeks after general elections, on the first day of the month, to coincide with the publication of the first Clark. Its term is roughly six months, each month coinciding with a Clark. Before the end of its last month the King shall issue a Writ of Dissolution ending its term. At the time the Cosâ is dissolved, all its members shall resign, but any Members holding positions in the Government may remain in those positions till the outcome of the election is resolved.

    Immigration Disclosure Act

    Whereas, a prospective immigrant's contact information is protected by law, and

    Whereas, this contact information may only be disclosed by the Minister of Interior to a limited number of parties, and

    Whereas, the relevant law states that information may be disclosed to the Cort as needed, and 

    Whereas, it does not, however, state it can be disclosed to the Attorney General's office as needed, and

    Whereas, it might be necessary to allow for such disclosure in the event that the need for prosecutions arises;therefore

A prospective's contact information such as telephone, address, email, AIM, ICQ, et cetera, shall be provided by the Minister of Interior only to the King, the Secretary of State, and the Cort, as needed.     WHEREAS It is possible to change provincial assignment based on the provincial assignment of relatives, which isn't conducive to having meaningful catchment areas, and

    WHEREAS We just spend almost a year making sure we have meaningful catchment areas, so we should use them, and

    WHEREAS There are also some provisions which prevent catchment areas from applying based on seemingly random criteria, and

    WHEREAS 49RZ13 already requires the consent of a citizen before that citizen is reassigned to the province whose catchment area they reside in, so there is no need for additional provisions such as those mentioned in the previous clause


    THEREFORE E.7.3.1, which currently reads;

    FURTHERMORE E.7.3.2, which currently reads;
     

    The provisions in this section do not apply when a citizen currently assigned to the wrong province geographically moves within his/her current geographic assignment area, unless the move is either a) over a distance of more than 1000 kilometres, or b) across national borders. In both cases the provisions in this section do apply.
     

    is amended to read;
     

    The Secretary of State will be responsible for the various moves and assignments which result from this title.  These moves and assignments will take effect on their official announcement by the Secretary of State.
     


    FURTHERMORE E.10, which currently reads;
     

    10. The following enhancements and clarifications will apply to the process of assigning citizens to provinces. (35RZ23)



    10.1. For the purposes of Talossan law, two people are “closely related” if one of them is the spouse, parent, grandparent, brother, sister, aunt, or uncle of the other, or is married to someone who is the spouse, parent, grandparent, brother, sister, aunt, or uncle of the other.

    10.2. If an immigrant is closely related to a Talossan citizen, the immigrant may choose to be assigned to the province to which his Talossan relative belongs, rather than to the province to which he would otherwise be assigned.

    10.3. If one Talossan citizen is closely related to another, he may move his provincial assignment to the province to which his Talossan relative already belongs. But nobody may make such a move more than once in his lifetime, except by the special permission of the Ziu.

    10.4. If any Talossan citizen is re-assigned, by any means, to another province, his/her close relative(s) may move his/her provincial assignment to the province which his/her Talossan relative has be re-assigned to. But nobody may make such a move more than once in his/her lifetime, except by the special permission of the Ziu.

    10.5. A dandelion, when registered, will be assigned to the province of his Talossan parent. If both his parents are citizens, and they belong to different provinces, the dandelion will be assigned to the province of his mother.

    10.6. A dandelion, whose Talossan parent has be re-assigned, by any means, to another province, shall be automatically re-assigned to the same province as his/her Talossan parent. If both his/her parents are citizens, and they are re-assigned to different provinces, the dandelion will be re-assigned to the province of his mother.

    10.7. Whenever any Talossan wants to move his provincial assignment to the province in whose assigned area he actually lives, he may do so by notifying the Chancery. The move will be officially recognised once the Chancery has validated the request. (47RZ2) (48RZ21)

    Statute

    WHEREAS The Organic Law has many provisions which would best be moved to statuary law, and

    WHEREAS A simpler, clearer Organic Law would encourage more people to read it, which would result in a more knowledgeable citizenry

    THEREFORE Article IX of the Organic Law, which currently reads;

    Section 1

    The Seneschál shall appoint a Secretary of State to an indefinite term. He may be removed and replaced by law. The Secretary of State shall supervise and organize the legislative business of the Ziu. He shall do this by administering a public venue for the inspection of legislative proposals before they become bills, "The Hopper" and by compiling and publishing the monthly legislative journal, "The Clark." He may delegate another citizen to act as Deputy Secretary of State, who will execute the powers and duties of the Secretary's office, while the Secretary is unavailable or unable to do so. This person shall be appointed and dismissed by the Secretary on whim. 

    Section 2

    Any Member of the Cosâ, or Senator, or the King, shall have the right to submit legislative proposals and bills to the Secretary of State for consideration by the Ziu according to the procedures specified in this article. 

    Section 3

    Except as provided in Article IX: Sec. 7, a bill is not eligible to be voted on by the Ziu and cannot be published in the Clark unless it was first submitted to "The Hopper" as a legislative proposal. And except as provided in Article IX: Sec. 8, only legislative proposals that are in "The Hopper" and have been there for at least ten days can become eligible for publication in "The Clark" as bills. Legislative proposals that are no longer in "The Hopper" cannot become bills. 

    Section 4

    The Secretary of State is under no obligation to create a permanent record of legislative proposals in "The Hopper." The Secretary of State shall remove legislative proposals from "The Hopper" at the request of the author. If a legislative proposal has remained in the "The Hopper" for more than 59 days, the Secretary of State may remove it. 

    Section 5

    A legislative proposal is submitted to the Secretary of State for publication in "The Hopper." A legislative proposal thus submitted should be followed by the words "Uréu q'estadra så" (or "Proposed by") and the name of the author and the capacity in which the author is offering the proposal. The Ziu may regulate how authors identify their capacity. A legislative proposal may be submitted by multiple sponsors, but the legislator whose name is listed first after the words "Uréu q'estadra så" (or "Proposed by") is considered the author of the legislative proposal. The Secretary of State may refuse to accept legislative proposals that are not clearly typed or word-processed. (47RZ37) 

    Section 6

    Bills that will be eligible for publication when the next clark is published and have spent at least five days in the hopper may be submitted with or without modification or amendment as a bill to the Secretary of State by the author according to the procedures specified in this article. The Secretary of State may, however, refuse to accept the bill if he finds that the bill is so substantially different from its original form as a legislative proposal that it constitutes a significantly different proposal. Upon such a finding, the bill is automatically returned to "The Hopper." 

    Section 7

    At his discretion, the Prime Minister shall have the right to withdraw any legislative proposal from "The Hopper" and instruct the Secretary of State to treat it as a properly submitted bill. The Prime Minister's Prime Dictates are exempt from all provisions relating to legislative proposals and "The Hopper." 

    Section 8

    For the first Clark to be published following an Election Deadline as defined in Article VII: Sec. 3, only legislative proposals that are in "The Hopper" and have been there for at least five days can become eligible for publication in "The Clark" as bills. 

    Section 9

    Bills must be submitted to the Secretary of State more than 24 hours before the publication of the Clark. Bills received less than 24 hours before publication of the Clark shall be published in the next Clark or postponed for one Clark, at the Secretary of State's discretion. 

    Section 10

    (Repealed by amendment) 

    Section 11

    If any bill seeks to amend, change, or repeal any Article of the Organic Law or any Law, the bill must specify exactly the Law(s) or Article(s), which it seeks to amend, change, or repeal. The Secretary of State may refuse to accept bills that do not comply with this provision. 

    Section 12

    All bills received by the Secretary of State during one calendar month shall be compiled into a published legislative journal, to be called "The Clark." The Clark shall be compiled prior to the first day of the following month, and shall be published on that day. 

    Section 13

    Notwithstanding Sections 2 and 6 of this Article, the Ziu may make laws regulating the number of bills a Member of the Cosâ or a Senator may submit for one Clark without the need to amend the Organic Law. (47RZ37)

    Shall be amended to the following;


    Section 1

Within the bounds and rules imposed by law, tradition, and reason, the Secretary of State shall ensure that all legislators be allowed to submit their bills for consideration.

    Section 3
    All bills received by the Secretary of State during one calendar month shall be compiled into a published legislative journal, to be called “The Clark”. The Clark shall be compiled prior to the first day of the following month, and shall be published on that day.

    Section 4
    At his discretion, the Prime Minister shall have the right to withdraw any legislative proposal from “The Hopper”, and instruct the Secretary of State to treat it as a properly submitted bill. Prime Dictates are exempt from all provisions relating unto legislative proposals. 

    Section 5
    If any bill seeks to amend, change, or repeal any Article of the Organic Law or any Law, the bill must specify exactly the Law(s) or Article(s), which it seeks to amend, change, or repeal. The Secretary of State may refuse to accept bills that do not comply with this provision.

    FURTHERMORE, upon the ratification of the above amendment by the People of Talossa, Title H of el Lexhatx, which currently reads;



     

    1. Future elections shall be followed, when practical, by an official Living Cosa which shall be styled the "State Opening of the Cosa." At the State Opening, the PM shall read his Speech to the Nation and the Leader of the Opposition shall have a chance to rebut. A Living Cosa shall be carried out at the same time, on the Government's first Clark. At the start of the State Opening, the new PM will be sworn in publicly. The State Opening shall feature food, drink, and as many Talossans as possible will be invited to attend. (15RC9)


    2. The Cosa authorises a question and answer period during Living Cosas. This will be called "Terpelaziuns" ('enquiries') or, for short, "Terps," or "Question Time." During Terpelaziuns, each MC may ask any other MC one question (plus a follow-up) and expect to receive some sort of answer. The Opposition Leader shall put the first question. Questions shall alternate between Government and Opposition members until all MCs on one side or the other have spoken. The remaining MCs may then put questions. Questions will be politely phrased in the third person and directed at the Speaker. Order of Questioners will be determined on an ad hoc basis by the Speaker. (14RC9) 
    2.1. Any Member of the Cosa (MC) or Senator may at any time between the First and Last Clark of a Cosa Term, table in “The Ziu” board on Witt, or its equivalent, a “c (PQ)” or “Terp” in a new thread or its equivalent. (44RZ1) 2.2. The PQ or Terp may ask one question to a named Member of the Government relating to Public Affairs connected with their Ministry or on matters of administration for which they are officially responsible. 2.3. There is no limit to the number of PQs or Terps a MC or Senator may submit in any given Clark. 2.4. Any PQ or Terp that is submitted by a MC or Senator in accordance with Section 1 above, must be answered by the named Minister within seven (7) days of the question being tabled. Should the Minister be unavailable to answer the question within the seven (7) days, the question shall be redirected to the Prime Minister or his/her appointed Deputy who shall be granted a further seven (7) days to answer the aforementioned question. With the agreement of the questioner, there may be a extension of seven (7) days on top of this period. However, the period from the asking of the question to the answering of the question, shall in no circumstances exceed twenty one (21) days. 2.5. For the purpose of subsection (a) above, “unavailable” means being unable for to access Witt, or its equivalent, for a acceptable and reasonable reason. Having Logged into or visited Witt during the seven day period, or its equivalent and having not seen or ignored the PQ or Terp, shall not constituent being unavailable. (c) This provision shall not apply PQs or Terps which refer to matters of Security or Defence of His Majesty’s Realm and/or any project(s), Correspondence or activities in which the Government has deemed and classed as confidential or its release may damage the Kingdom in any shape or form. Such questions may not be answered by any Minister. 2.6. The Minister must answer the question in the same thread or its equivalent as the original question and the questioner may ask one (1) supplementary question, in which subsection (a) above applies, with the seven days starting from the date the supplementary question is asked. 2.7. Failure to answer a question within the given timeframe shall constitute an offense and a Minister if found guilty of such a offense, will be subject to a punishment at the discretion of the Courts. 2.8. It shall be a defence to the Minister if the questioner, notwithstanding any other legitimate defences, did not or failed to: (i) Correctly title his/her question or; (ii) Ask a clear question. E.g. An ambiguous question, in which the Minister tried to clarify but failed to do so in the timeframe and did not subsequently answer. Or; (iii) Post his/her question in the correct board, or; (iv) Engage with the Minister in trying to answer his/her question or; (v) Direct the question to one named Minister. 
    3. All MCs must vote for themselves, and not through surrogates. They have innumerable options to communicate their own votes to the Secretary of State or to Undersecretary of State, including postcards, letters and phone calls. MCs are responsible for casting their own votes with their own assigned seats, and cannot cast votes for other MCs. If an MC will be unavailable to vote for some reason during any particular month, they may inform the Secretary or Undersecretary that they wish to vote exactly as another, named MC. That will be considered the sole justification for MC surrogate voting. (6RC30, 16RC11) 
    3.1. A person who is named as a Proxy Vote for another in a Living Cosâ is under the moral and legal obligation, whenever possible, to represent the original seat-holder's wishes and intentions on specific Ziu bills and the Vote of Confidence, whenever and however he is instructed or publicly notified to do so. (24RZ44) 

    4. A difference shall exist (and be spelled out in future bills) between committees (which are set up as standing committees, free to issue reports at any time) and Royal Commissions (or Commissions Royal) which are set up on an ad hoc basis and charged with a specific one-time task such as preparing a dossier or White Paper on a specific problem, and presenting the same to the Cosa. Once a Commission's paper is done, the Commission has fulfilled its duty and ceases to exist. (8RC35) 

    5. The Secretary of State will punish all Members of the Cosâ who cast invalid votes in the Vote of Confidence; the punishment being the declaration of said member's votes in the same Clark as null and void. (23RZ39) 

    6. His Majesty, when affixing His Royal Seal to Bills sent to him by this Ziu, may exclaim with all His Royal Royal-ness in the National Language of Our Nation, "El Regeu en volt." (25RZ17) 

    7. His Majesty, when acting out His Constitutional and Traditional Duty to Protect the Citizens of His Kingdom from Poor Government, decides to Withhold His Royal Seal from said Bill sent by said Ziu, may exclaim with all His Truth-and-Justice-ness in said National Language of said Kingdom, "El Regeu non en volt." 

    8. If the Prime Minister or a member of the Government party proposes a bill, and with the PM's permission marks it as a Government Bill, the Clark will denote this as a bill proposed by "HM Government, represented by" the member. If the Opposition Leader, or a member of the Opposition proposes a bill, and with the Opposition Leader's or the member's Party Leader's permission marks it as an Opposition Bill, the Clark will denote this as a bill proposed by "HM Loyal Opposition, represented by" the member. Any other bill will be called a Private Member's Bill, and will be denoted in the Clark the same way they've always been. (25RZ31) 

    9. Official non-Ziu titles may also be used when a member of the Ziu submit a bill, if the submitter feels that he is submitting a bill in another capacity as Ziu member. Such a title shall be called a "Limousine" or by its Talossan equivalent. A title of Senator, Distain or Member of the Cosa is a Ziu title, and as such not a Limousine. A person can only be entitled to a Limousine if he is both a member of the Ziu and holds an official title. A Limousine may contain, but is not restricted to: a governor's title, a minister or deputy minister's title, or a title conferred by a national organization such as the CÙG or the Secretary of State's office. This is not a means to allow non members of the Ziu to post bills using their Limousine, nor does this provision allow any submitter to use unofficial titles or party-specific titles. (32RZ13) 
    9.1. The use of a Limousine instead of a ziu title engages that person in that capacity. For example, a bill submitted by a Cosa member as being "Minister of Culture" indicates that the bill is trully submitted in the name of the Minister of Culture. 
    10. Members of Cosa shall be free to represent any constituency within the geographic boundaries of the Kingdom of Talossa including any and all of its territories and overseas colonies. Any Member wishing to represent a constituency shall publicly declare such representation before the conclusion of the first Clark following a General Election. (44RZ25) (48RZ3) 

    11. The Senatorial Medal of Honour may be awarded by the Senate for meritorious or honourable service to State or Nation. This award, awarded only and solely by a resolution in the Senate given the Royal Assent, will be the highest honour bestowed by the Talossan legislature. This award has a single class, and recipients may, in official RT affairs, affix the initials "S.H." (Senatorial Honour) after his/her name. (25RZ77) 

    12. The "Medal of Cincinnatus" may be awarded by the King in recognition for acts of extraordinary Talossanicity in the face of opposition. Recipients of this Medal would be entitled to follow their names with the honorific "Cin.". (37RZ8) 

    13. It is strongly suggested that MCs limit their bill submissions to five at the very most for each Clark. (25RZ91) 

    14. If there is the SLIGHTEST problem with any bill in excess of five (misspellings, inorganicity, etc.), the Secretary of State is empowered to refuse to put same on the Clark. 

    15. If at all possible, bills presented for review in the Hopper should be translated into Talossan before being Clarked. (38RZ12) 

    16. The King shall sign a physical printed copy of bills at the time they pass into law, and collect these bills for posterity. 

    17. Except in cases where the current Secretary of State is no longer able or eligible to perform his duties, any nominations of a new secretary of state must take effect on the day of the normal publication of a Clark. If the normally scheduled Clark is not published by the previous Secretary of State on the appropriate day, the new Secretary of State can still start his duties, starting with the publication of the Clark. (32RZ2) 

    18. No person shall hold more seats in the Cosa than ten times the total number of seats in the Cosa divided by the number of ballots cast for the Cosa in the most recent General Election, rounded up to the next integer.



     

    Shall be amended to read;


     

    1. Future elections shall be followed, when practical, by an official Living Cosă which shall be styled the “State Opening of the Cosa”. At the State Opening, the Prime Minister shall read his Speech to the Nation, and the Leader of the Opposition shall have a chance to rebut. A Living Cosă shall be carried out at the same time, on the Government's first Clark. At the start of the State Opening, the new Prime Minister will be sworn in publicly. The State Opening shall feature food, drink, and as many Talossans as possible will be invited to attend. (15RC9) 

    2. The Cosă authorises a question and answer period during Living Cosăs. This will be called “Terpelaziuns” ('enquiries') or, for short, “Terps”, or “Question Time”. During Terpelaziuns, each MC may ask any other MC one question (plus a follow-up), and expect to receive some sort of answer. The Opposition Leader shall put the first question. Questions shall alternate between Government and Opposition members until all MCs on one side or the other have spoken. The remaining MCs may then put questions. Questions will be politely phrased in the third person and directed at the Speaker. Order of Questioners will be determined on an ad hoc basis by the Speaker. (14RC9)

    6.1 For the first Clark to be published in a Cosă term, no bill may be published in a Clark unless it has spent at least five days in the Hopper as a legislative proposal 
    6.2 The Secretary of State is under no obligation to create a permanent record of legislative proposals in “The Hopper.”
    6.3 The Secretary of State shall remove legislative proposals from “The Hopper” at the request of the author.
    6.4 If a legislative proposal has remained in the “The Hopper” for more than 59 days, the Secretary of State may remove it.
    6.5 Bills must be submitted to the Secretary of State more than 24 hours before the publication of the Clark. 
    6.6 Bills received less than 24 hours before publication of the Clark shall be published in the next Clark or postponed for one Clark, at the Secretary of State's discretion.


    7. A legislative proposal should be followed by the words “Uréu q'estadra så” (or “Proposed by”), and the name of the author, and the capacity in which the author is offering the proposal. A legislative proposal may be submitted by multiple sponsors, but the legislator whose name is listed first after the words “Uréu q'estadra så” (or “Proposed by”) is considered the author of the legislative proposal.

    Statute

    WHEREAS A voter should know which individuals they are voting for when casting a vote for a certain party, and

    WHEREAS This will serve to increase accountability to the voters


    THEREFORE Org.VIII.3, which currently reads;

    Each party shall assign its seats to such individuals as it sees fit, provided that each such individual is eligible to serve in the Cosa under this article and is assigned a whole number of seats. The Ziu may by law establish a maximum number of seats that any one Member of the Cosa may hold by law, but the minimum number of Members of the Cosa shall be no less than the number of Senators, and the same limit shall apply to all Members of the Cosa, and any changes to the limit shall take effect no earlier than the distribution of seats after the next General Election.

    shall be amended to read

    Each party shall assign its seats to such individuals as it sees fit, subject to regulations regarding the reporting of such individuals prior to elections set forth by law, provided that each such individual is eligible to serve in the Cosa under this article and is assigned a whole number of seats.     FURTHERMORE, upon the ratification of the above amendment by the People of Talossa, a new subsubsection B.2.3 shall added to el Lexhatx which reads;

    B.2.3 The ballot must also include, for each party contesting the election, a list of citizens to whom the party intends to award Cosa seats.  If a party does not submit a candidate list to the Secretary of State before the election, the party leader is assigned all seats won, and seats which cannot be held by the Party Leader are forfeited.
        

        B.2.3.1 Before the conclusion of the first Clark, each party leader must submit to the Secretary of State a report containing the distribution of the seats won in the election
            
            B.2.3.1.1 The party leader may assign seats to any eligible citizen(s) they see fit, so long as the following criteria are met:
                B.2.3.1.1.1  The party's internal procedures are followed

                B.2.3.1.1.2  No one who was not named on the list is assigned more seats than any eligible citizen who was named on the list

                B.2.3.1.1.3  The total number of seats awarded to those not on the list does not exceed 1/3 of all seats won by the party

                B.2.3.1.1.4  No person occupies more than the legal number of seats.

            

            B.2.3.1.2  Any person assigned a seat as above may decline to take their seats in which case they will be reallocated according to the criteria of B.2.3.1.1.

            B.2.3.1.3  If a party cannot assign all of their seats under the criteria of B.2.3.1.1, the additional seats are forfeited. 

       

    Other subsubsections in B.2 are renumbered accordingly.

    Rejected by the Senäts

    WHEREAS We often have a July month of Recess due to inactivity,  and often, the month of August isn't much better AND

    WHEREAS we don't always have a month of recess AND

    WHEREAS there can be only one! AND

    WHEREAS Summer is Magic... 

    THEREFORE The Ziu resolves to put to a referendum the following addition to Section 3 of Article XIII of the Organic Law:

    If no month of Recess was called in the previous Cosa and a recess is called for the month of July, the Seneschal may instead decide to create two months of recess for July and August.

    The Seneschál may insert between any two Clarks, or after the final Clark, a "month of recess" in which no Clark is published and no Cosâ or Senäts business is conducted. No more than one "month of recess" may be declared during any one term of office. If no month of Recess was called in the previous Cosa and a recess is called for the month of July, the Seneschal may instead decide to create two months of recess for July and August.

    Rejected by the Senäts

    WHEREAS there were talks about creating fixed dates elections, in order to provide reliability and predictability for the electors AND

    WHEREAS no one ever did anything about it AND

    WHEREAS This proposal provides a single election per year, in January 15th, skipping the holiday season and two months of recess during the summer AND

    WHEREAS we get exactly 4 Clarks before the summer break and 4 Clarks after the summer break, a perfect symmetry AND

    WHEREAS We could call each of the 4 Clark period a "session" so that even if we have the same MC, we could ask the government to offer a different "agenda" for each AND

    WHEREAS Nothing prevents us to later easily change the summer recess to a 2 months election if we later feel that 1 year is too long AND

    WHEREAS This proposal, unlike the first version, doesn't have an election occurring at the same time as the Clark, staying closer to tradition AND

    WHEREAS this proposal allows for a new coalition if the government fails AND

    THEREFORE the Ziu resolves to put in a referendum the following changes to the Organic Law

    Section 3 of article 6 which currently reads:

    All elections to the Cosa are to be conducted during a period beginning from the fifteenth day of the calendar month following the dissolution of the prior Cosa until 7:30 p.m. on the first day of the subsequent month. The first day of this period (the fifteenth) is called the "Balloting Day" and the final day is called the "Election Deadline."

    Is replaced with:

    All elections to the Cosa are to be conducted during a period beginning from the fifteenth day of the calendar month of January until 7:30 p.m. on the first day of February. The first day of this period (the fifteenth) is called the "Balloting Day" and the final day is called the "Election Deadline."

    Section 1 of Article XIII which currently reads:

    Duration of the Cosâ. The Cosâ convenes on the first day of the month after general elections, to coincide with the publication of the first Clark. Its term is roughly six months, each month coinciding with a Clark. During its last month, the King shall issue a Writ of Dissolution ending its term. At the time the Cosâ is dissolved, all its members shall resign, but any Members holding positions in the Government may remain in those positions till the outcome of the election is resolved. 

    Is replaced by:

    Duration of the Cosâ. The Cosâ convenes on the first day of the month after general elections (March), to coincide with the publication of the first Clark. Its term is exactly 10 months, each month (except for July and August) coinciding with a specific Clark (for example, September is Clark #5). During its last month (December) the King shall issue a Writ of Dissolution ending its term. At the time the Cosâ is dissolved, all its members shall resign, but any Members holding positions in the Government may remain in those positions till the outcome of the election is resolved.  When this amendment is ratified, a transition period will be applied so that the following Cosa will have its election during the first of the following two events: After its 6th Clark is published, or in July of that year.

    In Section 2 of Article XIII, the word "six-month" is replaced by "eight-month", and the words "five Clarks" are replaced by "Seven Clarks"

    Section 3 of Article XIII which currently reads:

    The Seneschál may insert between any two Clarks, or after the final Clark, a "month of recess" in which no Clark is published and no Cosâ or Senäts business is conducted. No more than one "month of recess" may be declared during any one term of office.

    Is replaced by (explicitly overriding and taking priority over any other amendments put to referendum affecting this section in the same election):

    The months of July and August are months of recess in which no Clark is published and no Cosâ or Senäts business is conducted.

    Section 4 of Article XIII is removed

    The part os Section 6 of Article XIII which currently reads:

    the King shall dissolve the Cosâ and call new elections.

    Is replaced by (unless another bill is ratified which proposed a similar mechanic in which case it would take priority over this replacement):

    the King shall select a new Senechal he feels would be best able to succeed at a Vote of Confidence

    Section 3 of Article IV which currently reads:

    Each time the Cosa shall be dissolved, there shall be an election for one-third of the total Senate seats (rounded to the nearest whole number). The exact fixed order of rotation of provinces for elections shall be set by law and shall require two-thirds vote in the Cosa with approval by the King and the Senäts to be modified.

    Is replaced by:

    Each time the Cosa shall be dissolved, there shall be an election for approximately one-half of the total Senate seats (rounded to the nearest whole number) so that each Senator is elected for 2 years. The exact fixed order of rotation of provinces for elections shall be set by law and shall require two-thirds vote in the Cosa with approval by the King and the Senäts to be modified.

    Statute

    WHEREAS The Chancery currently uses the First-Past-The-Post method of voting to conduct Senate elections, and

    WHEREAS First-Past-The-Post voting is responsible for a variety of electoral ills, such as producing winners who do not actually have majority support, and forcing voters to cast ballots strategically instead of supporting the candidate they actually prefer the most, and

    WHEREAS We all know how First-Past-The-Post voting is working out for our giant friendly neighbor this election cycle, and

    WHEREAS Ranked Choice Voting (aka Instant Runoff Voting or Alternative Voting) is far superior to First-Past-The-Post and eliminates all of the aforementioned ills, because it allows voters to rank candidates in order of preference, and 

    WHEREAS This video is an brilliant explanation of why Ranked Choice Voting is so good


    THEREFORE Section 6 of Article IV, which currently reads;
     

    Any Senatorial election conducted by the Chancery shall be conducted according to the provisions given in Section 6 of Article VII concerning election to the Cosa, and the candidate receiving a plurality of the vote shall be declared the winner. In case of a tie between two or more candidates, the executive officer of the province shall select one of those candidates to be the Senator.

    WHEREAS The Organic Law has many provisions which would best be moved to statutory law, and

    WHEREAS A simpler, clearer Organic Law would encourage more people to read it, which would result in a more knowledgeable citizenry, and 

    WHEREAS Section 4 of Article X is redundant given the public's "right to know" in the Fourth Covenant, and given that reporting on the votes of the Ziu are already a duty of the SoS according to Lexh.C.1.1, and

    Statute

    WHEREAS recent well-intentioned reforms to the selection process for the office of Túischac'h have made it difficult to keep that office filled, and

    WHEREAS the Túischac'h serves no essential organic function, so there appears to be no reason why it should not be easier to change the manner of his or her selection, therefore

    THEREFORE BE IT RESOLVED by the Ziu of the Kingdom of Talossa that the following amendment to the Organic Law be recommended to the citizenry for ratification: 

    That Article XII, Section 9 of the Organic Law which currently reads:
     

    The King shall appoint a Member of the Cosa to serve as Speaker of the Cosa (Talossan: el Túischac'h), on the advice of a simple majority vote in the Cosa for the upcoming term. The Speaker shall preside, direct and maintain order during Living Cosas, in an unbiased fashion. Otherwise, his function will be to advise Members of Cosa of appropriate decorum. He is considered the honourable President of the Cosâ and shall be awarded all due veneration when serving as such.

    ADDITIONALLY, be it enacted by the Ziu of the Kingdom of Talossa that upon the ratification of the amendment to Organic Law proposed above, the following shall come immediately into force:

    El Lexhatx, Section H.19, which currently reads:
     

    19. Before the first Clark of a new Cosâ, and then again whenever the office of Túischac'h becomes vacant, the MCs shall convene as an Electoral Conclave under the leadership of the outgoing Túischac'h, or if none is available, the chronologically oldest MC. This Conclave shall decide upon a nominee for Túischac'h, who shall have the support of at least 50%+1 of the Cosa seats, and said nominee shall present himself for formal appointment to the King, as stated in OrgLaw XII.9. (48RZ29) 

    19.1 If there is no Túischac'h nor a nominee as chosen above on the first day of the month, a Warrant of Prorogation shall be issued as in OrgLaw XIII.2 if it is the first Clark of the Cosâ; or otherwise, a month of recess shall be declared as in OrgLaw XIII.3

    The Joseph McCarthy Amendment

    WHEREAS, expulsion from the Greatest (albeit unrecognized) Country on Earth is the highest form of punishment our judicial system can levy, and

    WHEREAS, as such, imposing such a penalty should not be taken lightly, and

    WHEREAS, currently, Organic Law permits the Uppermost Cort to impose the penalty upon citizens it convicts of "anti-Talossan activities", and

    WHEREAS, it obviously fails to define what exactly "anti-Talossan activities" are, and

    WHEREAS, this sounds very similar to the (US) House Un-American Activities Committee to me, and

    WHEREAS, we don't need McCarthyism in Talossa, so

    THEREFORE, the Ziu hereby resolves to put forward the following amendment to the Citizenry for ratification:

    Article XVII, Section 5 of Organic Law which currently reads:

     

    If the Uppermost Cort shall at any subsequent time find any fraud or dishonesty in a Citizen's original application for citizenship, including his statements to the Cort or to Cosâ members; or if the Uppermost Cort shall convict the Citizen for anti-Talossan activities, it may impose the penalty of expulsion from Talossa. The King may commute such a sentence.
