    Statute

    WHEREAS there is now a vacancy on the Uppermost Cort;

    AND WHEREAS throughout most of Talossan history, the Uppermost Cort was set at 3 members;

    AND WHEREAS that tradition was broken at the time the old Magistrate's Cort was folded into the CpI;

    AND WHEREAS we now have a chance to restore this tradition;

    AND WHEREAS the effect of this bill will be to confirm the CpI at its current size of one Senior Judge and two Puisne Judges, as foreseen in OrgLaw VIII.3;

    AND WHEREAS this bill was already passed into law, as 59RZ1, but under the provisions of OrgLaw VIII.3, this resizing must be approved by a 2/3 majority of the Cosa, once again in this Cosa;


    BE IT REAFFIRMED by the King, Cosa and Senäts of Talossa in Ziu assembled that El Lexhatx G.1.1, which previously read

     

    The Ziu enlarges the number of Puisne Judges to a total of three in accord with Section 3 of Article VIII of the Organic Law.

    Statute

    Whereas, under current statute both the Mençéi and Túischac'h can appoint temporary replacements, and

    Whereas, under current statute this option is not yet available to the Avocat-Xheneral, and

    Whereas, recent circumstances have highlighted the need for the Avocat-Xheneral to have this option as well, and

    Whereas, this bill was passed by the previous Cosa, but with reference to the wrong part of El Lexhatxh

    Therefore, be it enacted by the Ziu of the Kingdom of Talossa, that El Lexhatx Title H 2.1.5.3.1. which currently reads as:
     

    2.1.5.3.1. The Mençéi and the Túischac'h may at any time appoint and dismiss one Senator and one Membreu dal Cosă, respectively, to serve as a member of the CRL in their place.

    Whereas, during the last Cosa term, former Seneschal Braneu Excelsio, without being obliged to do so, answered several citizen enquiries, and

    Whereas, these answers in the absence of meaningful enquiries from the then-Opposition served the purpose of government accountability, and

    Whereas, this is a new practice worth continuing for the same honorable purpose.

    Therefore, be it resolved, that El Lexhatx Section H. Legislation is amended to add a new sub-section, as follows:
     

    1.2.9 Any citizen, may at any time between the First and Last Clark of a Cosă Term, table in "The Lobby" board on Witt, or its equivalent, a "(CT)" or "Citaxhién Terpelaziun" in a new thread or its equivalent.
    1.2.9.1 Any "(CT)" or "Citaxhién Terpelaziun," requires the sponsorship of a current member of the Ziu.
    1.2.9.2 The "(CT)" or "Citaxhién Terpelaziun" may ask one question to a named Member of the Government or Civil Service, relating to Public Affairs connected with their Ministry or on matters of administration for which they are officially responsible.
    1.2.9.3 A citizen is limited to one (1) active "(CT)" or "Citaxhién Terpelaziun" at a time. Active, in this context, is defined as an unanswered CT.
    1.2.9.4 Any "(CT)" or "Citaxhién Terpelaziun" that is submitted, must be answered by the named Minister, Civil Service member, or other Government official within fourteen (14) days of the question being tabled. Should the Minister, Civil Service member, or other Government official be unavailable to answer the question within the fourteen (14) days, the question shall be redirected to the Seneschal or their appointed Deputy or the Minister responsible for oversight of the Civil Service member or other Government official who shall be granted a further seven (7) days to answer the aforementioned question. With the agreement of the questioner, there may be an extension of seven (7) days on top of this period. However, the period from the asking of the question to the answering of the question, shall in no circumstances exceed twenty-eight (28) days.

    Whereas, it is a vital national interest to have an election administration authority free of actual or reasonably perceived partisan partiality, and

    Whereas, the below-proposed restrictions (as a part of ensuring this interest are modelled after those written by @Miestră Schivă, UrN  in 53RZ2 The Civil Service (Commissioner Abolition) Bill, and

    Whereas, this bill would still allow parties to appoint whoever they choose as national party officers but those officers themselves would not be permitted to serve as Secretary of State simultaneously.

    Therefore, be it enacted by the Ziu, that El Lexhatx C.5 which currently reads:
     

    5. The Secretary of State shall hold no seat in the Ziu.


    Is amended to read as follows:
     

    5. The Secretary of State shall not hold the offices of Monarch, Seneschal, Distain, Judge of the Uppermost Cort, any cabinet portfolio, any party officer position in a political party at the national level, or member of the Ziu.

    Whereas, presently the King, Seneschal, and Secretary of State can request an advisory opinion from the Cort pü Inalt, and

    Whereas, presently the Government's chief legal advisor, the Avocat-Xheneral, can't request an an advisory opinion from the Cort pü Inalt, and

    Whereas, it seems reasonable for the Government's chief legal advisor to have the ability to also seek advice from the Judiciary.

    Therefore, be it enacted by the Ziu of the Kingdom of Talossa that Article VIII, Section which currently reads as:

    Article VIII, Section 6

    Until such time as inferior corts are established, a Judge may sit as a nisi prius cort in all civil and criminal matters.

    No decision or order issued by an inferior cort or nisi prius cort shall bind a coordinate cort.

    The decisions or orders of the Cort pü Inalt shall bind all lower corts according to the doctrine of stare decisis provided that that the panel was composed of no less than three Judges after necessary recusal. The Cort pü Inalt may, as it deems appropriate, issue decisions or orders that are non-binding provided that it explicitly states that intention in the decision or order.

    A nisi prius cort or an inferior cort deviating from binding precedent must state so with clarity and refer the matter for appellate review.

    Notwithstanding any contrary proscription, the King, the Secretary of State, or the Seneschal may refer an issue to the Cort pü Inalt for an advisory opinion provided that any such panel reviewing the position is composed of no less than three Judges after any necessary recusal, there lacks a live case or controversy that would otherwise determine the issue, and there is a reasonably need for resolution of the question.

    A matter arising under the Covenants of Rights and Freedoms is appealable as of right to the Cort pü Inalt. In all other instances, the Cort pü Inalt may not be compelled to exercise its appellate authority. However, when declining to do so, the Cort pü Inalt must issue an order declaring such, and no such declaration shall be deemed as the Cort pü Inalt adopting or setting as binding precedent the appealed from decision or order.

    The Cort pü Inalt, and any other cort existing under this article, shall interpret all matters through the lens of the Covenants of Rights and Freedoms.

    Any Judge that is a named party in a matter shall recuse himself or herself from hearing any and all parts of the matter.

    BE IT ENACTED by the King, Cosă and Senäts in Ziu assembled that El Lexhatx H.2.1.2, which currently reads:
     

    2.1.2. A bill has passed the Hopper if it has spent at least 10 days in the Hopper, and is exclusively limited to the following:

        2.1.2.1. Non-binding proclamations that have no effect other than express the wish of the Cosa, Senate, or Ziu as a whole, in which case the bill must contain the words "Sense of the Cosa", "Sense of the Senate" or "Sense of the Ziu" in its title.
        2.1.2.2. Proclamations that establish the position of the Ziu on a foreign policy issue.
        2.1.2.3. Establishment of a committee that has no powers other than advisory powers and whose recommendations must still be approved by the Ziu in order to be binding and making appointments to such a committee.
        2.1.2.4. Appointments to functions that are already defined in law and for which the Ziu is explicitly allowed to make appointments according to law.
        2.1.2.5. Any decision which the law explicitly allows the Ziu to make without the bill containing such a decision having to go through committee.
        2.1.2.6. Removing a regent or consenting to the re-appointment of a regent in accordance with Org.II.5.
        2.1.2.7. Revoking a Prüm Diktat.
        2.1.2.8. Notices of reprimand in accordance with Org.VIII.5.
        2.1.2.9. The granting or restoration of citizenship.


    shall be amended by the amendment of 2.1.2.6 to read:
     

    2.1.2.6. Removing a regent or consenting to the re-appointment of a regent in accordance with Org.II.5, or confirming the nomination of an Heir Presumptive in accordance with Org.II.7.


    and by the addition of two more paragraphs:
     

    2.1.2.10. A bill that was passed by the previous Cosa but, due to Organic Law provisions, must be passed once again to take effect.
    2.1.2.11. A bill that was passed by a previous Cosa but did not take effect due to drafting errors, which are explicitly corrected in the revised bill.

    1.5. The Royal Treasury, headed by the Burgermeister of Inland Revenue. The function of the treasury is to
    1.5.6. provide, upon request of the Minister of Finance and any other time stated in law, a Financial Report containing the following information:

        1.5.6.1. the amount, location, liquidity, and availability of all funds held by or for the Royal Treasury,
        1.5.6.2. a detailed list of all changes in the account balances of the Royal Treasury since the last Report,
        1.5.6.3. a balance sheet which clearly lists all expenses linking them to the relative sheet items in the budget bills approved in the Cosa,
        1.5.6.4. the total amount of louise and postal items in circulation;


    be amended to read:

    Statute

    WHEREAS under current arrangements the Attorney-General can simultaneously hold the position of Clerk of the Corts;

    AND WHEREAS under same current arrangements a Deputy Clerk of the Corts cannot be appointed if s/he also hold the portfolio of Attorney General or Minister of Justice, due to the nature of these duties;

    AND WHEREAS due to the nature of these duties it makes sense to also extend this prohibition to the Clerk of the Cort and not just their Deputies;

    AND WHEREAS there is some duplication in 2 sections regarding Deputies that needs tidying up;


    THEREFORE BE IT ENACTED by the King, Cosâ and Senäts of Talossa in Ziu assembled as follows:

    Section 4.8 of El Lexhatx G. Justice, which currently reads:

    "The individual holding the office of Clerk of the Corts shall enjoy immunity from civil or criminal suit for any actions performed in the course of his or her official duties while holding this office. This immunity shall be lost upon leaving office. Due to the nature of the Clerk's responsibilities, an individual may not hold the office of Clerk of the Corts, or any deputy thereunder, while simultaneously holding office as a Justice of the Uppermost Cort or any national inferior court."

    Shall be amended to read as follows:

    "4.8. The individual holding the office of Clerk of the Corts shall enjoy immunity from civil or criminal suit for any actions performed in the course of his or her official duties while holding this office. This immunity shall be lost upon leaving office. Due to the nature of the Clerk's responsibilities, an individual may not hold the office of Clerk of the Corts, or any deputy thereunder, while simultaneously holding office as a Justice of the Uppermost Cort or any national inferior court or the portfolio of Attorney General or any office within the Ministry of Justice."

    Furthermore, Section 5.4 of El Lexhatx G. Justice, which currently reads:

    "5.4. Due to the nature of these duties, no deputy shall be appointed who is seated on the bench of the Uppermost Cort or any inferior cort. Nor shall any appointee hold the portfolio of Attorney General or Minister of Justice."

    Is hereby repealed in full.

    WHEREAS the Legislative Chancery of the Province Formerly Known as Benito passed an Act renaming that Province to Belacostă; and

    WHEREAS the citizenry of that Province did approve of the renaming via referendum; and

    Statute

    WHEREAS, the Organic Law directs that His Majesty's Government submit a Budget by the second Clark of the current term of the Cosă,

    SECTION A - Financial Report

    THEREFORE, His Majesty's Government notifies the following financial report to the Ziu:

     

    The current funds of the Kingdom consist of a checking account, a savings account, and a PayPal account. The former two are currently held at Ally Bank, and are in the process of being transferred to Wells Fargo Bank by the Burgermeister of Inland Revenue.

    Based on reporting from the Burgermeister of Inland Revenue as of 30 June 2024, and subsequent payment of registration fees between July 2nd and July 11th, these accounts stand at the following balances:
     
    • Checking:  31¤04 (US$46.60)
    • Savings:  826¤39 (US$1,239.97)
    • PayPal:    427¤04 (US$640.59)
    Total:          1284¤46 (US$1,927.16)

    Between the June 30th Treasury report and the previous Treasury report as included in the Budget for the 59th Cosă, the following changes had occurred:
     
    • Savings:  + 19¤57 (US$29.93) from interests earned
    • PayPal:  + 54¤08 (US$81.21) from a contribution by one citizen totaling 3¤20 (US$5.00), payment of registration fees by COFFEE and IND, and sales of coins, stamps and items on printify.com
    Total :        + 74¤06 (US$111.14)

    No expenditures have occurred, as Talossa's webpresence is run at no cost for the time being.

    Since the June 30th Treasury report, a number of registration fee payments have been publicly noted by the Burgermeister, along with a single contribution:
     
    • PayPal:  + 46¤40 (US$70.00) from a contribution by one citizen totaling 3¤20 (US$5.00) and payment of registration fees
    Total :        + 46¤40 (US$70.00)


    SECTION B - Budget

    FURTHERMORE, His Majesty's Government hereby submits to the Ziu a request for the appropriation of funds from the Royal Treasury, totaling 266¤40 (US$400.00), for the specific purposes and subject to restrictions as outlined herein:

    - Ministry of Culture: 33¤20 (US$50.00) for cultural grants
    - Ministry of Technology: 133¤20 (US$200.00) for speculative webhosting costs
    - Ministry of Foreign Affairs: 33¤20 (US$50.00) for expenditure by the Bureau of Humanitarian Aid and International Development
    - Ministry of STUFF: 33¤20 (US$50.00) for the issuing of ID cards
    - Prime Ministry: 33¤20 (US$50.00) for supplemental funding to other appropriated funds, and for small expenses (eg. postage) by the Government and Royal Civil Service

    FURTHERMORE, notwithstanding the above allocations, no funds shall be disbursed without a notice of disbursement having first been transmitted to the Ziu at least fourteen days prior to the disbursement, except that disbursements solely for the purpose of postage may be made with no less than 24 hours notice. Notices shall contain details of the purchase and a cost estimate for the purchase, or the total amount paid if seeking funds for reimbursement. Copies of receipts and/or invoices will be provided upon request to Members of the Ziu.

    FURTHERMORE, any funds allocated by this section shall be retained in the Royal Treasury's accounts by the Burgermeister of Inland Revenue until such time as they are disbursed. Funds not disbursed prior to the end of the term of His Majesty's Government shall remain in the central fund.

    SECTION C - Investment Policy

    FURTHERMORE, His Majesty's Government hereby directs the Burgermeister of Inland Revenue to continue investing all held funds, except for an amount of liquidity needed for day to day operation up to half of the total of appropriated funds as listed in this Budget, into a high-interest savings account unless or until otherwise directed or advised by act of the Ziu.

    Rejected by the Senäts

    Whereas, one problem that was mentioned in the past is the difficulty in finding successors for the position of SoS, and

    Whereas, a past proposal made to address this problem ran into concerns that it reduced the control the SoS had to name a successor, and 

    Whereas, in the simple proposal below it is suggested to keep other members of the Chancery as "unofficial Deputy SoS's" but change the current rules so that they may be allowed to succeed the SoS on his or her leaving.

    Therefore, the Ziu enacts the following amendment to Section 1.2.3 of el Lexhatx which currently reads as follows:
     

    1.2.3. Members of the Chancery are to be considered as if they were Deputy Secretary of State, without the ability to replace the Secretary should he become unavailable. Members may act in the name of the Secretary of State and perform official business as delegated to them by the Secretary. Once the requirements of M.2.1[r 8] above have been fulfilled, at least three members of the Chancery at any time shall have all the access required to carry out the Chancery's functions under this section.


    Is amended to read as follows:

    Statute

    WHEREAS the Government of Talossa desires that frivolous applications for Talossan citizenship be discouraged, but serious applications get all the help that they need;

    BE IT ENACTED by the King, Senäts and Cosă of Talossa in Ziu assembled as follows:

    1. That El Lexhatx E.2 be amended by addition of the bolded text as follows:

     


    2.1 The Minister of Immigration shall ascertain to his own satisfaction, through correspondence or conversation, that the prospective immigrant is a real human being with genuine interest in becoming a citizen of the Kingdom of Talossa. The Minister shall be free to inquire of the applicant on any and every subject, and shall be required to collect the legal name or name used in daily life, postal address (optional if the applicant is under 18 years of age, except for information needed to assign the applicant to a province), telephone number, and e-mail address(es) of the candidate, which information the Minister shall communicate to the Secretary of State. The applicant shall affirm or swear, under penalty of perjury and under the provisions of Lexh.A.16.1., that this information is accurate, and shall provide documentary evidence of the same if the Minister thinks it appropriate.

    2.2 Additionally, the Immigration Minister shall be required to collect an essay, written by the applicant, entitled "Why I am Interested in Becoming a Talossan." If the Immigration Minister considers that this essay misunderstands the nature of Talossa or the rights and duties of Talossan citizenship, or gives insufficient information to enable citizens to ask meaningful questions of the prospective, they may require the applicant to submit a rewritten essay before proceeding to the next stage. When doing so, the Immigration Minister shall provide the applicant with sufficient information to do so successfully, or indicate where to find such information.

    2.3 The Immigration Minister shall also allow every applicant to indicate, whether in the essay described elsewhere in this section or otherwise, what part or parts of Talossan life are the Special Interests of the applicant. These may include Politics, Language, Culture, Heraldry, or any other categories as the Minister may see fit or that may be suggested by the applicant.

    2.4 The Immigration Minister shall make a monthly report to the Ziu reporting the number of immigration applications received in that month which did not proceed because failing to fulfil the requirements of this section. For each failed application the Minister shall note which part or part of the requirements of this section were lacking in the application.

    2. That El Lexhatx E.3 be amended by addition of the bolded text and deletion of struck-through text as follows:

     

     

    3. The Minister of Immigration, working with the Seneschal, the Minister of Stuff, The Permanent Secretary to the Cabinet Technology and/or the nation's Wittmeister shall cause the prospective immigrant to be granted an account on Wittenberg, allowing said prospective immigrant to converse with the subjects of the Kingdom gathered there. The Immigration Minister shall verify that the said account is fully-enabled, and that the candidate is able to communicate using this forum with the citizens of the Kingdom. The Immigration Minister shall then begin a single thread on Wittenberg introducing the prospective immigrant to the nation. The "Why I am Interested in Becoming a Talossan" essay shall be published by the Immigration Minister in this introduction. The Immigration Minister is further directed to remind his fellow citizens from time to time that the initiation of new citizens into Talossa is a serious matter and that questioning a prospective citizen is a patriotic obligation of all who love their King and Country.

        3.1 The Ministry of Immigration shall note the prospective immigrant's future provincial assignment in the introducing thread.

       3.2 The Ministry of Immigration shall also publish any Special Interests identified by the prospective citizen in the application, and put them in touch with Talossan citizens who are identified by the Ministry as being able and willing to help them pursue those interests. In doing so the Ministry shall not promote any particular political party to the exclusion of any other.

    3. That El Lexhatx E.5 be amended by addition of the bolded text as follows:

     

     

    5. If, at any point during the process, either before or after creation of the Wittenberg account, the Immigration Minister determines that the prospective immigrant shall not be considered further, the prospective immigrant shall be informed of this decision, and shall be made aware that a Grant of Citizenship may yet be obtained by the disappointed applicant if an act of the Ziu be passed directing that such a grant be issued. Any account created for the applicant on Wittenberg shall then be terminated.

         5.1 Any person, whose citizenship is denied, may in the first case appeal this decision by application to the Secretary of State, and be given the Chancery's contact details to enable them to do so. The Secretary of State may, if they believe the Ministry of Immigration has misused their discretion under Talossan law, report to the Ziu with their reasons for so deciding and recommend that the applicant or prospective citizen be given citizenship by act of the Ziu. Alternatively, the applicant or prospective may reapply by undergoing the entire procedure (minus any successfully completed portions) following the next general election.

    4. That El Lexhatx E.7 be amended by addition of the bolded text as follows:

     

     

    7. The Secretary of State shall, on a date of his choosing, but within a period of ten days after receiving a petition from at least two citizens to issue a Grant of Citizenship as described in clause 4, and upon certification from the Ministry of Immigration that the prospective citizen has sufficient understanding of Talossan life and culture for full participation, determine the provincial assignment of the prospective immigrant and issue a Royal Grant of Citizenship to the immigrant. This Grant shall be issued under the Royal Seal, either as applied by the Chancery, or, should the Majesty request, by the Sovereign under his or her own hand. If requested by the Government, the Grant may also bear the signatures of the Seneschal and/or Immigration Minister. The Royal Grant shall be promptly issued coincident with the candidate affirming his fealty to the Royal House and his allegiance to the Kingdom by taking any Oath of Talossan Citizenship specified by law. At the time this Royal Grant is issued, and from that point forward, the applicant shall be a full citizen of the Kingdom of Talossa. The fact of the issuance of this Grant shall be posted on Wittenberg by the Secretary of State, that the new citizen may be welcomed by his compatriots. Any and all objections raised to the immigration made after this Royal Grant will be moot.

    Rejected by the ZIU

    WHEREAS, there is a need to identify the responsible official overseeing the implementation of the automatic governmental information transmittal mandated by 58RZ6, and

    WHEREAS, Cabinet discussions are currently sealed for seven years before release is allowed by the Royal Archivist, and

    WHEREAS, this need has led to confusion when attempting to satisfy the above-mentioned mandate.


    THEREFORE, be it enacted by the King, Cosa and Sënats in Ziu assembled that El Lexhatx Section D.8.9 which currently reads as follows:
     

    8.9 Automated Governmental Information Transmittal
    8.9.1 All internal government communications on Government-owned fora shall be transmitted to the Royal Archives as soon as feasibly possible after the conclusion of that Government's term of office.
    8.9.2 These transmittals shall be released to the public by the Royal Archives seven (7) years after the conclusion of that Government's term of office.
    8.9.3 No communications containing protected information covered by El Lexhatx sections D. 8.2, D. 8.3, and D. 8.4 shall be included in the transmittals.

    Furthermore, The transmittal scheme shall begin with the internal government records of the Tzaracomprada Cabinet (58th Cosa).


    Is amended to read as follows:

    WHEREAS the judicial tenure section of the law is long and appears mostly pointless, and also it's weird to have these elaborate requirements for how we're supposed to address retired magistrates, and we should have simpler laws when we can, and

    WHEREAS if these are bringing anyone real joy through their use, please just say so and we can keep them,

    THEREFORE, section 11 of Title G, which currently reads:

     

    11. Judicial Tenure.
    Judges of the Uppermost Cort and of any inferior court may retire through voluntary leave of office. This shall be accomplished through submitting a letter of retirement to the King. The retirement shall take effect immediately upon confirmed receipt by the King or an authorized representative.
    11.1. Uppermost Cort Judges may be compelled to retire through organic removal from office through an act of the Ziu in accordance with Article VIII of the Organic Law. In accordance with the appropriate section, the inactivity of a Justice is defined as the failure of that Justice to act, rule, or appear in an open case the Justice is assigned to or participating in for more than 60 days, as certified by the Ziu in a majority vote.
    11.1.1 A Justice of the Cort pü Inalt shall be declared inactive, and to have vacated their seat, within the meaning of Organic Law VIII, if the Clerk of the Corts, contacting the members of the CpI to assign a case as described in this title, is unable to contact that Justice or does not receive any response to their enquiries, within 30 days.
    11.2. Retired Judges or Magistrates shall enjoy the style "Honourable Mister/Madame" for life in commemoration of their service to the Nation, and may utilize the title "Retired Judge/Magistrate."
    11.3. Retired status will be honorary in nature and shall not confer any authority or responsibility within any Talossan Court or the National Talossan Bar or over its members, students or associates. Neither shall these titles, in and of themselves, confer membership in the National Talossan Bar enabling the holder to engage in the practice of law.
    11.4. Retired status can be revoked only in the event of a conviction by a Talossan Court for misconduct while serving in a judicial capacity. In the event of such conviction, revocation of retirement privileges shall be contained as part of the sentencing order. Retired status can also be revoked by the Ziu through majority vote, without needing to go through committee, and approval by the Monarch. Such legislative action can be taken only after the retiree has been convicted by a Talossan Court for misconduct while serving in a judicial capacity and only after all appeals have been exhausted.
    11.5. Retired status will also be revoked in the event the retiree shall be convicted of a felony by any Court of the Realm. Felony convictions by a provincial court shall be forwarded to the Minister of Justice for review. If cause for revocation of retirement status is found based upon the nature of the conviction, the Minister of Justice shall propose or cause to be proposed a measure of the Ziu to revoke any and all privileges of retirement from the accused, after all appeals have been exhausted.
    11.6. Retired status shall be considered waived if a retired Justice, Judge or Magistrate resigns their citizenship and shall be considered revoked if the retiree has their citizenship terminated by a Court of the Realm.
    11.7 Every person appointed a judge to the Uppermost Cort of Talossa shall publicly make to the Citizens of Talossa and subscribe to the following declaration within 10 days of such appointment:
    I, [NAME], do solemnly, sincerely and truly affirm and declare that I will duly, faithfully and to the best of my knowledge and ability execute the office of Judge of El Cort pü Inalt without fear or favour, affection or ill will towards any man, woman or child and that I will uphold the Organic Law and the laws of the Kingdom of Talossa. This I do solemnly affirm.
    is replaced in its entirety with the following text:

     

    11.1.  Uppermost Cort Judges may be compelled to retire through organic removal from office through an act of the Ziu in accordance with Article VIII of the Organic Law.     WHEREAS, the intent of the CRL to provide a forum for the improvement of bills was honorable, and

    WHEREAS, this can be achieved with a longer stay in the Hopper and without that extra body.

    THEREFORE, be it enacted that the Ziu of the Kingdom of Talossa enacts the following changes in El Lexhatx:

    H.2.1.5 through H.2.1.6.2 are repealed in their entirety:
     

    2.1.5. For each Cosă term is created a Comità da Redacziun Legislatïu (in english Legislative Advisory Committee), hereinafter "the CRL", which shall review or revise all legislative items from the Hopper once they have moved to committee; and may recommend acceptance or rejection , or suggest amendments in their best judgment.
    2.1.5.1. The main, but not exclusive, purpose of the CRL, with the assistance of the Scribery, shall be to evaluate bills from the technical point of view of the quality of the legislation, the correctness of the language, the internal consistency of the document and consistency with existing legislation.
    2.1.5.2. The CRL shall conduct all its deliberations openly in the Hopper.
    2.1.5.3. The CRL shall consist of the incumbent Mençéi, Túischac'h, and Avocat-Xheneral.
    2.1.5.3.1. The Mençéi, Túischac'h, and Avocat-Xheneral may at any time appoint and dismiss one Senator or one Membreu dal Cosă, to serve as a member of the CRL in their place.[716]
    2.1.5.4. The CRL may create further committees to which their functions may be delegated, as concerns any bill or category of bills. Such a committee must have at least 3 members, including at least 1 Membreu dal Cosă and 1 Senator.
    2.1.6. After the CRL has given its recommendation, or if it gives no recommendation within 30 days of the bill having passed to committee, the bill has passed the Hopper and the sponsor of the bill may ask for it to be Clarked, with or without amendments.
    2.1.6.1. The same bill can not be submitted to the Clark more than once in the same Cosa, unless the original bill was vetoed, the original bill had been retired or voted down by its main sponsor during the voting period, or the bill has been substantially amended, as judged by the Secretary of State.
    2.1.6.2. Bills must be submitted to the Secretary of State more than 24 hours before the publication of the Clark. Bills received less than 24 hours before publication of the Clark shall be published in the next Clark or postponed for one Clark, at the Secretary of State's discretion.


    The current H.2.1.3 and H.2.1.4 are deleted and replaced with the following:

    2.1.3 A bill is said to have passed the Hopper and the sponsor of said bill may ask for it be clarked after satisfying both of the following conditions: It has spent at least 20 days in the Hopper, and at least two of the following officers (Mençéi, Túischac'h, and Avocat-Xheneral) have expressed that they have no objections after reviewing the bill from the technical point of view of the quality of the legislation, the correctness of the language, the internal consistency of the document and consistency with existing legislation; or it has spent at least 30 days in the Hopper without a recommendation from the above-mentioned officers responsible for review. For the purpose of the review described above, the Mençéi, Túischac'h, and Avocat-Xheneral may at any time appoint and dismiss one Senator or one Membreu dal Cosă, to serve as a reviewer of the Hopper bills in their place.
    2.1.4 The same bill can not be submitted to the Clark more than once in the same Cosa, unless the original bill was vetoed, the original bill had been retired or voted down by its main sponsor during the voting period, or the bill has been substantially amended, as judged by the Secretary of State.

    WHEREAS the recent reforms to immigration emphasising "quality over quantity" raised valid concerns about the Immigration Minister having too much discretion;

    AND WHEREAS a possible form of abuse of discretion would be for the Immigration Minister to petition for grants of citizenship and to expect "favours" from new citizens in return;

    BE IT ENACTED that El Lexhatx E.7 be amended by the insertion of the words in bold:

    7. The Secretary of State shall, on a date of his choosing, but within a period of ten days after receiving a petition from at least two citizens, neither of whom shall be the Minister of Immigration or anyone to whom they have delegated their powers, to issue a Grant of Citizenship as described in clause 4, and upon certification from the Ministry of Immigration that the prospective citizen has sufficient understanding of Talossan life and culture for full participation determine the provincial assignment of the prospective immigrant and issue a Royal Grant of Citizenship to the immigrant. This Grant shall be issued under the Royal Seal, either as applied by the Chancery, or, should the Majesty request, by the Sovereign under his or her own hand. If requested by the Government, the Grant may also bear the signatures of the Seneschal and/or Immigration Minister. The Royal Grant shall be promptly issued coincident with the candidate affirming his fealty to the Royal House and his allegiance to the Kingdom by taking any Oath of Talossan Citizenship specified by law. At the time this Royal Grant is issued, and from that point forward, the applicant shall be a full citizen of the Kingdom of Talossa. The fact of the issuance of this Grant shall be posted on Wittenberg by the Secretary of State, that the new citizen may be welcomed by his compatriots. Any and all objections raised to the immigration made after this Royal Grant will be moot.

    41.1.1. Dynastic Orders
    41.1.1.1. The Order for the Nation (L'Urderi per la Naziun): The Order for the Nation is the senior order and is the most commonly awarded. The Crown recognises worthy citizens, offering them admission into the order for long and dedicated service to the nation, or for particular acts of valour in the defence of the realm. The Order of the Nation has one grade, that of Knight or Dame, and are entitled to add the honorific 'UrN' to their name.

All recipients of this grade shall be entitled to add the honorific of "UrN-C." All existing members of L'Urderi per la Naziun that are not currently ranked, shall automatically assume the rank of Knight Commander or Dame Commander, upon passage of this bill.

    41.1.1.1.3 The lowest grade, which does not entitle the recipient to bear the title of Knight or Dame, shall be that of Officer of The Order of the Nation. All recipients of this grade shall be entitled to add the honorific of "UrN."

    WHEREAS, the current legislation around Terpelaziuns is not fit for purpose, and more specifically

    WHEREAS, it seems designed for Living Cosas of the Ben Era, which are long gone, and

    WHEREAS, it does not reflect the actual practice of Terpelaziuns as questions posed on an online board, and

    WHEREAS, it is peppered with several minor oddities, such as undefined acronyms, intrusions by one branch of the State into another, and inconsistent terminology, and

    WHEREAS, it may be additionally helpful to further formalise modern practice into law, such as responses by deputy ministers, so

    THEREFORE BE IT ENACTED by the Ziu of the Kingdom of Talossa that El Lexhatx Title H Section 1.2, which currently reads:
     

    1.2. The Cosă authorises a question and answer period during Living Cosăs. This will be called "Terpelaziuns" ('enquiries') or, for short, "Terps", or "Question Time". During Terpelaziuns, each MC may ask any other MC one question (plus a follow-up), and expect to receive some sort of answer. The Opposition Leader shall put the first question. Questions shall alternate between Government and Opposition members until all MCs on one side or the other have spoken. The remaining MCs may then put questions. Questions will be politely phrased in the third person and directed at the Speaker. Order of Questioners will be determined on an ad hoc basis by the Speaker.
        1.2.1. Any Member of the Cosă (MC) or Senator may at any time between the First and Last Clark of a Cosă Term, table in "The Ziu" board on Witt, or its equivalent, a "c (PQ)" or "Terp" in a new thread or its equivalent.
        1.2.2. The PQ or Terp may ask one question to a named Member of the Government relating to Public Affairs connected with their Ministry or on matters of administration for which they are officially responsible.
        1.2.3. There is no limit to the number of PQs or Terps a MC or Senator may submit in any given Clark.
        1.2.4. Any PQ or Terp that is submitted by a MC or Senator in accordance with the provisions of H.1.2., must be answered by the named Minister within seven (7) days of the question being tabled. Should the Minister be unavailable to answer the question within the seven (7) days, the question shall be redirected to the Seneschal or his/her appointed Deputy who shall be granted a further seven (7) days to answer the aforementioned question. With the agreement of the questioner, there may be a extension of seven (7) days on top of this period. However, the period from the asking of the question to the answering of the question, shall in no circumstances exceed twenty one (21) days.
        1.2.5. For the purpose of H.1.2.4., "unavailable" means being unable to access Witt, or its equivalent, for an acceptable and reasonable reason. Having logged into, or visited Witt, or its equivalent, during the seven day period, and having not seen, or ignored the PQ or Terp, shall not constitute being unavailable. (c) This provision shall not apply PQs or Terps, which refer to matters of Security or Defence of His Majesty's Realm and/or any project(s), correspondence, or activities, in which the Government has deemed, and classified as confidential, or which in its release may damage the Kingdom in any shape or form. Such questions may not be answered by any Minister.
        1.2.6. The Minister must answer the question in the same thread or its equivalent as the original question and the questioner may ask a reasonable number of supplementary questions (as determined by the presiding officer), in which the provisions of H.1.2. apply, with the seven days starting from the date each supplementary question is asked.
        1.2.7. Failure to answer a question within the given timeframe shall constitute an offence, and a Minister, if found guilty of such an offence, will be subject to a punishment at the discretion of the Courts.
        1.2.8. It shall be a defence to the Minister if the questioner, notwithstanding any other legitimate defences, did not, or failed to:
            1.2.8.1. correctly title his/her question
            1.2.8.2. ask a clear question. E.g. an ambiguous question, in which the Minister tried to clarify, but failed to do so in the time frame, and did not subsequently answer.
            1.2.8.3. post his/her question in the correct board
            1.2.8.4. engage with the Minister in trying to answer his/her question
            1.2.8.5. direct the question to one named Minister.

    1.2   A Terpelaziun is a written enquiry to a named Member of the Government (henceforth, "the questioned Minister") relating to Public Affairs connected with their Ministry or on matters of administration for which they are officially responsible.
        1.2.1   Any Member of the Cosă or Senator may pose a Terpelaziun at any time between the first Clark of a term and the subsequent publishing of a Writ of Dissolution.
            1.2.1.1   Terpelaziuns are posed by opening a new thread containing the questions on Wittenberg, in a single board jointly designated by the Túischac'h and Mençei.
            1.2.1.2   Terpelaziuns shall be politely phrased in the third person and addressed to the presiding officer of the questioner's House (e.g. "esteemed Túischac'h/Mençei") - or, if the Terpelaziun is being posed by a presiding officer, to the whole House ("esteemed Members of the Cosă/Senators").
            1.2.1.3   The presiding officer of the questioner's House - or, if the Terpelaziun is being posed by a presiding officer, the presiding officer of the other House - shall ensure compliance with the provisions of this article and oversee the question-and-answering process. Henceforth in this article, the person so identified shall be termed "the presiding officer".
            1.2.1.4   There is no limit to the number of Terpelaziuns a Member of the Cosă or Senator may submit in any given Clark.
            1.2.1.5   There is no hard limit to the number of questions a single Terpelaziun may contain, except that the presiding officer may refuse Terpelaziuns that are unreasonably long, or that span overly different topics.
            1.2.1.6   Terpelaziuns may not be posed during Months of Recess, except by leave of the presiding officer and consent of the questioned Minister.
                1.2.1.6.1   Terpelaziuns still pending (at any stage) at the beginning of a Month of Recess, or at the Dissolution of the Cosă, shall be answered as normal.
        1.2.2   Once a Terpelaziun is submitted by a Member of the Cosă or Senator in accordance with the provisions of this article, it shall be answered by the questioned Minister within seven days, except for provisions extending the deadline as described below.
            1.2.2.1   Junior members of the questioned Minister's ministry may ask leave to reply to the Terpelaziun in the questioned Minister's stead, due to unavailability or due to the question falling under the junior member's purview.
            1.2.2.2   The questioned Minister, a junior member of the questioned Minister's ministry, or the Seneschal, may negotiate with the questioner any extensions to the deadline, as long as the total additional negotiated time does not exceed seven days. The presiding officer shall grant any such extensions upon ascertaining the questioner's consent.
            1.2.2.3   Should the questioned Minister be unavailable to answer the Terpelaziun within the initial or extended deadline, the question shall be redirected to the Seneschal, or to a junior member of the questioned Minister's ministry, who shall be granted a further seven days to answer the Terpelaziun.
                1.2.2.3.1   "Unavailable" shall be taken to mean an inability to access Wittenberg for an acceptable and reasonable reason. Having logged into, or visited Witt, or its equivalent, during the seven day period, and having not seen, or ignored the PQ or Terp, shall not constitute being unavailable.
        1.2.3   The questioned Minister, or other applicable official as described above, must answer the Terpelaziun in the same thread as the original question, and the questioner may ask a reasonable number of supplementary questions, as determined by the presiding officer.
            1.2.3.1   All provisions described in the previous section shall apply to the first (round of) supplementary question(s) as if they were a new Terpelaziun.
            1.2.3.2   Once the first (round of) supplementary question(s) have been answered, the floor shall be considered open to contributions from other Members of the Cosă and Senators. Any questions posed in this stage shall not be bound by any formal time constraints.
        1.2.4   Failure to answer a Terpelaziun or a supplementary question within the deadlines described in this article may be declared by the presiding officer to constitute Contempt of the Ziu, except in the cases outlined below.
            1.2.4.1   The questioner shall engage with the questioned Minister in answering the Terpelaziun, by providing any required clarifications within a reasonable timeframe.
            1.2.4.2   The questioned Minister is excused from answering Terpelaziuns that, as judged by the presiding officer: do not fall under the purview of their portfolio, or are not clearly labelled as a Terpelaziun; or are ambiguous, unclear, or poorly formatted; or do not otherwise comply with the provisions of this article.
            1.2.4.3   Terpelaziuns which refer to matters of Security or Defence of His Majesty's Realm and/or any project(s), correspondence, or activities, in which the Government has deemed, and classified as confidential, or which in its release may damage the Kingdom in any shape or form, may not be answered by any Minister.
